- I wish to participate as a Merchant at the Pagan Unity Festival. I understand that Pagan Unity Festival Inc. makes no representations or claims as to the condition or safety of the land, structures or surroundings of Montgomery Bell State Park whether or not owned, leased, operated or maintained by Pagan Unity Festival Inc.
- I understand that Pagan Unity Festival Inc. does not provide any insurance coverage for my merchandise or personal property. I understand that I am responsible for my safety, my own health care needs and the protection of my merchandise and my personal property.
- I understand that if I cancel my booth at the festival less than 30 days before the date of the festival, no refunds will be given.
- I understand that the Merchant Coordinator will assign all booth spaces on a first come/first served basis, except in the case of medical necessities. I will notify the Merchant Coordinator if I have special needs due to medical disabilities when I return this contract.
I agree to the following stipulations as a Merchant at the Pagan Unity Festival:
- To release from liability, agree to indemnify and hold harmless Pagan Unity Festival and any Pagan Unity Festival agent acting within the scope of his/her duties for any injuries that may occur to my person, my merchandise, or my property.
- To arrive at the site at 9:00 A.M. or after on the first day of the festival, and not before. I understand that if I arrive before the designated time, I will be turned away at the gate and will have to wait.
- To clear the site by 12:00 Noon on Sunday. I understand that this means that all of my merchandise, personal property, tents, campers and cars will be off the property at the set time. I understand that breakdown must begin no later than 10 A.M.
- To pay all Merchant fees within 72 hours of approval. I understand that if payment is not made within that time, no space will be held for me.
- To pay all Festival fees before the start of the festival.
- To refrain from selling alcohol, illegal substances or paraphernalia.
- To hold blameless the Pagan Unity Festival for any merchandise or property that is lost, stolen or damaged.
- To be responsible for my own booth setup, tear down, booth needs (chairs, tables, awnings or tents) and clean up of booth site.
- To have my trash out for last pick-up on Sunday, or take it away myself.
- To keep my vending area clear and free of debris at all times.
- To only sell the items that have been approved in advance by the Merchant Coordinator. I understand that if I display any items not approved, I will be asked to remove those items and put them out of sight.
- To comply with all State, County and Local ordinances and regulations. I will comply with the rules for regular attendees as well as Merchant rules.
- I understand that animals, except for service animals, are not allowed at PUF.
- I further understand that if I do not abide by these requirements, I may be ejected from site with no refund and I may not be allowed to Merchant at PUF in the future.
In exchange, Pagan Unity Festival agrees to the following stipulations;
- To have the Merchant Coordinator or their designee available for merchants from the time of arrival to the time of departure.
- To provide security during festival.
- To arrange for trash pickup from the merchant area daily, or more often as needed.
- To exempt Merchants from the mandatory 1.5 hours of community service.
The festival coordinators request each merchant to donate one item to be placed in the raffle that will be held on Saturday evening. The money raised from the raffle is donated to a worthy Pagan person or charity.
I understand that this contract shall be binding on myself, successors in interest, or any person or persons who would attempt to sue on my behalf.
I UNDERSTAND THAT THIS IS A LEGAL DOCUMENT. I HAVE READ, UNDERSTAND AND AGREE WITH ALL OF THE STATEMENTS AND TERMS IN THIS DOCUMENT. I UNDERSTAND THAT THIS DOCUMENT IS COMPLETE UNTO ITSELF AND THAT ANY ORAL PROMISES OR REPRESENTATIONS MADE TO ME CONCERNING THIS DOCUMENT AND/OR THE TERMS CONTAINED HEREIN ARE NOT BINDING UPON PAGAN UNITY FESTIVAL INC OR THE AGENTS OF PAGAN UNITY FESTIVAL INC. I EXECUTE THIS DOCUMENT VOLUNTARILY AND WITH FULL KNOWLEDGE OF ALL THE MEANINGS CONTAINED HEREIN.
